1. Objecte i àmbit d’aplicació
A continuació s’estableixen els termes i condicions de la venda d’entrades de la Torre Bellesguard de Gaudí, a través del present lloc web https://bellesguardgaudi.com o mitjançant venda directa a la taquilla física, en compliment del que estableix la Llei 34/2002, de serveis de la societat de la informació i del comerç electrònic, i de conformitat també amb el Reial decret legislatiu 1/2007, de 16 de novembre, pel qual s’aprova el text refós de la Llei general per a la defensa dels consumidors i usuaris i la resta de normativa aplicable i lleis complementàries, si escau.
2. Identificació de les parts
La Torre Bellesguard de Gaudí és gestionada per Grupo Catalana Occidente Activos Inmobiliarios S.L.U., entitat del Grup Catalana Occident, S.A. (d’ara endavant, la entitat o la propietat indistintament), amb domicili al c/ Bellesguard núm. 20 (CP 08022), Barcelona, essent aquesta la titular de l’espai i responsable de la prestació del servei de visita cultural.
La venda i gestió d’entrades per a la Torre Bellesguard de Gaudí es presta a través de Tiqueteo Spain, S.L. (d’ara endavant, CLORIAN), amb CIF número B-66045345 i domicili al c/ Veneçuela, 103, 08019 Barcelona.
S’adquireix automàticament la condició d’USUARI i, igualment, la de CLIENT, una vegada efectuada la compra, reconeixent que la transacció econòmica es realitza amb CLORIAN, sense perjudici que la visita sigui prestada per la Torre Bellesguard.
3. Acceptació de les condicions
La compra d’entrades implica l’acceptació plena i sense reserves de les presents Condicions Generals del servei aquí reflectides.
4. Procediment de compra
El procés de compra pot requerir la introducció de dades personals del comprador, la selecció de la data i del tipus d’entrada.
5. Preu i mitjans de pagament
El preu de les entrades inclourà l’IVA i consta especificat al lloc web i al recinte de la Torre Bellesguard. Els preus podran ser modificats en qualsevol moment a discreció de la propietat. Així mateix, la compra d’entrades pot generar despeses de gestió, que seran assumides pel CLIENT.
Les formes de pagament establertes i els pagaments efectuats es processaran a través de CLORIAN, de manera que la entitat no emmagatzema ni gestiona directament les dades de pagament.
6. Absència de dret de desistiment
Al CLIENT no li assisteix el dret de desistiment en la compra de les entrades, en tractar-se d’un servei vinculat a una activitat d’oci, amb una data i un període d’execució específics, segons el que estableixen els articles 97 l) i 103 lletra l) del Reial decret legislatiu 1/2007, de 16 de novembre, pel qual s’aprova el text refós de la Llei general per a la defensa dels consumidors i usuaris i altres lleis complementàries.
7. Dret d’admissió i cancel·lacions per força major
La entitat es reserva el dret d’admissió i, en particular, el dret a denegar l’accés a la Torre Bellesguard a aquells usuaris que, pel seu comportament, puguin alterar la seguretat i la integritat de l’edifici o de les seves instal·lacions.
La entitat es reserva el dret de cancel·lar i/o modificar l’accés per motius de força major i/o aliens a la seva voluntat, sense avís previ a l’usuari i sense que això doni lloc a cap tipus d’indemnització a favor de l’usuari, amb la salvetat, quan escaigui, de la devolució del preu de l’entrada no utilitzada.
8. Accés i condicions de la visita
El CLIENT ha de conservar la seva entrada i mostrar-la al personal de control a l’accés, i haurà de conservar-la fins a la sortida.
El personal de la Torre Bellesguard pot denegar l’entrada o expulsar aquelles persones que incompleixin les normes de seguretat, alterin l’ordre públic o impedeixin el desenvolupament normal de la visita.
Està prohibit accedir al recinte amb objectes o substàncies que puguin suposar un risc per a la integritat de les persones i de l’edifici (armes, substàncies perilloses, objectes de grans dimensions, objectes punxants o tallants, etc.). Tots els bosses i paquets hauran de passar el control de seguretat.
Està prohibit l’accés a persones amb símptomes evidents d’embriaguesa o sota els efectes d’estupefaents. Es prega respectar les zones enjardinades sense causar cap deteriorament a plantes, flors i elements decoratius.
Així mateix, no està permesa la revenda ni cap ús promocional de l’entrada sense l’autorització escrita de la propietat.
9. Responsabilitat
La entitat no es fa responsable de pèrdues, furts, robatoris ni de qualsevol dany sofert durant la visita.
El CLIENT és responsable de la correcta utilització de l’entrada i del compliment de les normes d’accés i de visita.
10. Protecció de dades personals
Les dades personals del CLIENT i/o de l’USUARI, segons correspongui, es tractaran de conformitat amb el Reglament (UE) 2016/679, general de protecció de dades, amb la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals, i amb la normativa de desenvolupament vigent en cada moment (d’ara endavant, normativa de protecció de dades personals).
El responsable del tractament, de conformitat amb la normativa de protecció de dades personals, és Grupo Catalana Occidente Activos Inmobiliarios S.L.U., entitat del Grup Catalana Occident, S.A. (d’ara endavant, GCO).
Les dades s’utilitzaran exclusivament per a les finalitats següents:
a) Gestionar la compravenda d’entrades, incloent-hi la facturació i el control de pagaments.
b) El control d’accessos al recinte en la data seleccionada.
c) Atendre sol·licituds, consultes o incidències relacionades amb la visita i/o la compra.
d) Enviament de comunicacions informatives en relació amb la compra d’entrades.
El CLIENT té dret a accedir, rectificar, cancel·lar, suprimir i oposar-se al tractament de les dades, així com a exercir la resta de drets reconeguts per la normativa vigent en matèria de protecció de dades, mitjançant comunicació escrita al Delegat de Protecció de Dades a l’adreça electrònica: dpo@gco.com.

11. Propietat intel·lectual
La Torre Bellesguard és un edifici de propietat privada, i l’accés a l’immoble queda subjecte a les presents condicions generals, d’obligat compliment per a qualsevol usuari.
Tot visitant pot realitzar fotografies i/o gravacions estrictament per a record personal i/o familiar, quedant expressament prohibida qualsevol reproducció, distribució, comunicació pública (inclosa la posada a disposició), transformació i/o explotació de fotografies i/o vídeos que no siguin estrictament personals i/o familiars.
Per a la realització de fotografies i/o gravacions audiovisuals amb finalitats diferents de les previstes en el paràgraf anterior, siguin o no comercials, l’usuari i/o qualsevol tercer hauran d’obtenir prèviament una autorització expressa i per escrit de la entitat.
12. Jurisdicció i llei aplicable
Les presents Condicions Generals de Contractació es regeixen per la legislació espanyola. Les parts renuncien expressament a qualsevol altre fur que els pugui correspondre i se sotmeten als Jutjats i Tribunals de Barcelona per a la resolució de qualsevol conflicte derivat o relacionat amb aquestes Condicions Generals de Contractació.
Si alguna de les clàusules incloses en aquestes Condicions Generals de Contractació fos declarada totalment o parcialment nul·la o ineficaç, aquesta nul·litat o ineficàcia afectarà únicament la disposició o la part de la mateixa afectada, i la resta de les Condicions Generals romandran vigents, considerant-se no posada la disposició o la part afectada.
