Les présentes conditions régissent la vente de billets pour la Torre Bellesguard de Gaudí, via le présent site web https://bellesguardgaudi.com ou par vente directe au guichet physique, conformément à la Loi 34/2002 relative aux services de la société de l’information et au commerce électronique, ainsi qu’au Décret législatif royal 1/2007 du 16 novembre, approuvant le texte consolidé de la Loi générale pour la défense des consommateurs et des usagers, et à toute autre réglementation applicable et législation complémentaire, le cas échéant.
2. Identification des parties
La Torre Bellesguard de Gaudí est gérée par Grupo Catalana Occidente Activos Inmobiliarios S.L.U., société du groupe Grupo Catalana Occidente S.A. (ci‑après, l’Entité ou la Propriété, indifféremment), dont le siège social est situé C/ Bellesguard nº 20, 08022 Barcelone. Cette société est propriétaire des lieux et responsable de la prestation du service de visite culturelle.
La vente et la gestion des billets pour la Torre Bellesguard de Gaudí sont assurées par Tiqueteo Spain S.L. (ci‑après, CLORIAN), immatriculée sous le numéro CIF B‑66045345, dont le siège social est situé C/ Venezuela, 103, 08019 Barcelone.
La qualité d’UTILISATEUR et de CLIENT est acquise automatiquement une fois l’achat effectué, étant entendu que la transaction financière est conclue avec CLORIAN, sans préjudice du fait que la visite est assurée par la Torre Bellesguard.
3. Acceptation des conditions
L’achat de billets implique l’acceptation pleine et sans réserve des présentes Conditions générales de vente et de service.
4. Procédure d’achat
La procédure d’achat peut nécessiter la saisie de données personnelles de l’acheteur, ainsi que la sélection de la date et du type de billet.
5. Prix et modes de paiement
Le prix des billets inclut la TVA et est indiqué sur le site web ainsi que dans les locaux de la Torre Bellesguard. Les prix peuvent être modifiés à tout moment à la discrétion de la Propriété. L’achat de billets peut également entraîner des frais de gestion, qui seront à la charge du CLIENT.
Les moyens de paiement proposés et les paiements effectués sont traités par CLORIAN, l’Entité ne stockant ni ne gérant directement les données de paiement.
6. Absence de droit de rétractation
Le CLIENT ne bénéficie pas du droit de rétractation pour l’achat des billets, dans la mesure où il s’agit d’une prestation liée à une activité de loisirs comportant une date ou une période d’exécution spécifique, conformément aux articles 97(l) et 103(l) du Décret législatif royal 1/2007 du 16 novembre, approuvant le texte consolidé de la Loi générale pour la défense des consommateurs et des usagers et autres lois complémentaires.
7. Droit d’admission et annulations pour force majeure
L’Entité se réserve le droit d’admission et, en particulier, le droit de refuser l’accès à la Torre Bellesguard à tout utilisateur dont le comportement pourrait compromettre la sécurité et l’intégrité du bâtiment ou de ses installations.
L’Entité se réserve également le droit d’annuler et/ou de modifier l’accès pour des raisons de force majeure ou indépendantes de sa volonté, sans préavis et sans droit à une quelconque indemnisation, sauf, le cas échéant, le remboursement du billet non utilisé.
8. Accès et conditions de visite
Le CLIENT doit conserver son billet et le présenter au personnel de contrôle à l’entrée, et le conserver jusqu’à la sortie.
Le personnel de la Torre Bellesguard peut refuser l’accès ou expulser toute personne ne respectant pas les règles de sécurité, troublant l’ordre public ou entravant le bon déroulement de la visite.
Il est interdit d’accéder au site avec des objets ou substances susceptibles de présenter un risque pour la sécurité des personnes et du bâtiment (armes, substances dangereuses, objets volumineux, objets tranchants ou pointus, etc.). Tous les sacs et colis doivent être soumis au contrôle de sécurité.
L’accès est interdit aux personnes présentant des signes évidents d’ivresse ou se trouvant sous l’influence de stupéfiants. Les visiteurs sont priés de respecter les zones paysagées et d’éviter tout dommage aux plantes, fleurs et éléments décoratifs.
La revente ou tout usage promotionnel du billet est interdit sans l’autorisation écrite préalable de la Propriété.
9. Responsabilité
L’Entité décline toute responsabilité en cas de perte, vol, larcin ou de tout dommage survenu au cours de la visite.
Le CLIENT est responsable de la bonne utilisation de son billet ainsi que du respect des règles d’accès et de visite.
10. Protection des données à caractère personnel
Les données personnelles du CLIENT et/ou de l’UTILISATEUR, selon le cas, seront traitées conformément au Règlement (UE) 2016/679 relatif à la protection des données (RGPD), à la Loi organique 3/2018 du 5 décembre relative à la protection des données à caractère personnel et à la garantie des droits numériques, ainsi qu’à la réglementation d’application en vigueur (ci‑après, la réglementation sur la protection des données).
Le responsable du traitement est Grupo Catalana Occidente Activos Inmobiliarios S.L.U., société du groupe Grupo Catalana Occidente S.A. (ci‑après, GCO).
Les données seront utilisées exclusivement aux fins suivantes :
a) Gestion de la vente de billets, y compris la facturation et le contrôle des paiements.
b) Contrôle des accès aux installations à la date sélectionnée.
c) Traitement des demandes, consultations ou incidents liés à la visite et/ou à l’achat.
d) Envoi de communications informatives relatives à l’achat de billets.
Le CLIENT peut exercer ses droits d’accès, de rectification, d’effacement, d’opposition et tout autre droit reconnu par la réglementation en vigueur en adressant une communication écrite au Délégué à la protection des données à l’adresse électronique suivante : dpo@gco.com.

11. Propriété intellectuelle
La Torre Bellesguard est un bâtiment de propriété privée, et l’accès à l’immeuble est soumis aux présentes Conditions générales, obligatoires pour tout utilisateur.
Les visiteurs peuvent prendre des photographies et/ou réaliser des enregistrements strictement à des fins de souvenir personnel ou familial. Toute reproduction, distribution, communication publique (y compris la mise à disposition), transformation et/ou exploitation de photographies et/ou vidéos à des fins autres que strictement personnelles ou familiales est expressément interdite.
Pour toute prise de photographies et/ou d’enregistrements audiovisuels à des fins autres que celles prévues ci‑dessus, commerciales ou non, l’utilisateur et/ou tout tiers devra obtenir préalablement une autorisation écrite expresse de l’Entité.
12. Juridiction et droit applicable
Les présentes Conditions générales de vente sont régies par le droit espagnol. Les parties renoncent expressément à toute autre juridiction qui pourrait leur être applicable et se soumettent aux Tribunaux de Barcelone pour le règlement de tout litige découlant des présentes Conditions générales de vente ou en lien avec celles‑ci.
Si l’une quelconque des clauses des présentes Conditions générales de vente devait être déclarée totalement ou partiellement nulle ou inefficace, cette nullité ou inefficacité n’affectera que la clause ou la partie concernée, les autres dispositions demeurant pleinement en vigueur, la clause affectée étant réputée non écrite.
